CABIN RENTAL AGREEMENT, TERMS OF USE, LIABILITY WAIVER & ASSUMPTION OF RISK

This Cabin Rental Agreement ("Agreement") is entered into between James River Hideout, LLC ("Property"), and the individual making the reservation ("Guest"). By making a reservation, submitting payment, checking in, occupying the property, or allowing any member of Guest's party to occupy the property, Guest agrees to all terms contained herein. This Agreement applies to all guests, invitees, visitors, children, and pets accompanying Guest during their stay.

RESERVATION, PAYMENT & OCCUPANCY

Guest must be at least twenty-one (21) years of age to reserve a cabin. Full payment is due according to the booking terms communicated at the time of reservation. Guest remains personally responsible for all charges associated with the reservation. Cabins are designed to accommodate a maximum of five (5) overnight guests unless prior written approval is obtained from management. Only registered guests may occupy the cabin overnight. Unauthorized occupants may result in immediate termination of the reservation without refund. Management reserves the right to refuse service, cancel reservations, or remove any guest from the property for violations of this Agreement, unsafe conduct, illegal activity, excessive disturbance, or behavior deemed detrimental to other guests, staff, or the property.

CHECK-IN / CHECK-OUT

Check-In: After 3:00 PM Check-Out: By 11:00 AM

Early arrivals and late departures may be accommodated only with prior approval. Guests who remain beyond checkout time without authorization may be subject to additional charges.

CANCELLATION POLICY

We will make every effort to accommodate reservation changes made well in advance of arrival. Cancellations made more than seventy-two (72) hours before arrival will incur a cancellation charge equal to one night's stay. Cancellations made within seventy-two (72) hours of arrival forfeit the full reservation amount. No refunds or credits will be issued for early departures, no-shows, weather conditions, river conditions, road conditions, personal emergencies, or circumstances outside the control of James River Hideout, LLC.

Because the property is located along the James River, flooding and severe weather conditions occasionally occur. If management determines the property is unsafe or inaccessible and cancels a reservation prior to arrival, Guest may choose either a full refund or a rebooking credit. If evacuation is required after check-in due to flooding or another emergency, any refund or credit will be determined solely by management based on the circumstances.

Guest acknowledges that river levels, weather conditions, water clarity, floating conditions, beach conditions, and access to outdoor amenities are natural conditions beyond the control of management. The temporary closure of Eagles Bluff Beach, river access areas, floating operations, or outdoor amenities due to flooding, unsafe river conditions, severe weather, or other natural events shall not constitute grounds for a refund, discount, or cancellation outside of the policies stated herein.

All refunds, when approved, will be processed to the original payment method.

CABIN USE

Guests are expected to treat the cabin, furnishings, grounds, and facilities with care and respect. Basic amenities including linens, towels, cookware, kitchen utensils, Wi-Fi, and access to the shared outdoor cooking area are provided for Guest convenience. Guests agree to leave the cabin in substantially the same condition in which it was received. Excessive cleaning requirements, removal of stains, odor remediation, damage repairs, missing items, or extraordinary housekeeping services may result in additional charges. Guests should inspect the cabin upon arrival and promptly report any maintenance concerns or existing damage. Failure to report damage may result in Guest being held responsible for repairs.

SEPTIC SYSTEM

The cabins operate on a private septic system. To prevent costly damage and service interruptions, Guests agree not to flush or dispose of any items other than toilet paper. The following items are strictly prohibited from being placed into toilets, sinks, showers, or drains:

• Baby wipes or cleaning wipes (including products labeled "flushable")

• Feminine hygiene products

• Paper towels

• Diapers

• Cotton balls or swabs

• Dental floss

• Grease, fats, or cooking oils

• Food waste

• Chemicals, solvents, or hazardous materials

Any septic backup, plumbing service call, repair, or damage resulting from prohibited use may be charged to the Guest responsible for the reservation.

SMOKING POLICY

All cabins and buildings are strictly non-smoking and non-vaping. Evidence of smoking, vaping, marijuana use, or other prohibited substances inside any cabin will result in a minimum cleaning and remediation charge of $250, in addition to any actual damages incurred.

PET POLICY

One pet under 40 lbs is permitted only in Cabin 1 and only with prior approval from management and payment of the required $40 pet fee. Pets are not permitted in Cabins 2, 3, or 4 under any circumstances. Unauthorized pets found in any cabin will result in a minimum $250 cleaning fee and may result in immediate termination of the reservation without refund. Approved pets must remain under the owner's control at all times and may not be left unattended unless securely kenneled. Guests are responsible for cleaning up after pets and for all damages, injuries, or disturbances caused by their animals. Management reserves the right to require removal of any animal creating a disturbance or presenting a safety concern. The Animal Waiver contained within this Agreement applies to all approved pets.

PROPERTY RULES

Quiet hours are from 10:00 PM until 7:00 AM.

The speed limit throughout all property roads is 10 MPH.

Fireworks are prohibited unless specifically authorized by management.

Fires are permitted only in designated fire pits and approved fire areas.

Guests shall properly dispose of all trash in designated receptacles.

Glass containers are prohibited on Eagles Bluff Beach, in the river, and in designated outdoor recreation areas.

Guests acknowledge that Eagles Bluff Beach and river access areas may be temporarily closed or restricted at any time due to river levels, flooding, weather conditions, safety concerns, or other natural conditions. Management reserves the right to restrict access whenever necessary for guest safety.

Excessive intoxication, disorderly conduct, harassment, hate speech, threatening behavior, or mistreatment of staff or other guests will not be tolerated and may result in immediate removal without refund.

Children under sixteen (16) years of age must remain under direct supervision of a parent or responsible adult at all times.

ACCESS TO RESORT FACILITIES

Guest acknowledges that their stay may include access to or use of facilities operated by affiliated entities including:

• James River Hideout, LLC

• Horsecreek Ranch & Retreat, LLC

• Float the James, LLC

• 3 Creeks Land and Cattle, LLC

Such facilities may include beaches, river access points, trails, campgrounds, parking areas, recreational equipment, floating activities, swimming areas, and other outdoor amenities. Use of these facilities is voluntary and at Guest's own risk.

ASSUMPTION OF RISK

Guest understands that outdoor recreation and riverfront properties contain inherent risks that cannot be eliminated regardless of the level of care exercised by management. These risks include, but are not limited to:

• Swimming

• Tubing

• Kayaking

• Paddleboarding

• Floating

• Fishing

• River currents

• Submerged obstacles

• Slippery surfaces

• Uneven terrain

• Wildlife encounters

• Insects and snakes

• Falling limbs or trees

• Severe weather

• Lightning

• Flooding

• Vehicle accidents

• Acts of other guests

Guest voluntarily assumes all risks associated with occupancy of the property and participation in any recreational activity.

RELEASE OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, GUEST HEREBY RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE JAMES RIVER HIDEOUT, LLC, HORSECREEK RANCH & RETREAT, LLC, FLOAT THE JAMES, LLC, 3 CREEKS LAND AND CATTLE, LLC, THEIR OWNERS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, REPRESENTATIVES, AND AGENTS FROM ANY CLAIMS FOR PERSONAL INJURY, DEATH, PROPERTY DAMAGE, LOSS, EXPENSE, OR OTHER DAMAGES ARISING FROM OR RELATED TO GUEST'S USE OF THE PROPERTY OR PARTICIPATION IN ANY ACTIVITY.

This release applies whether such claims arise from negligence, premises conditions, natural hazards, actions of other guests, weather conditions, or any other cause except where prohibited by law.

INDEMNIFICATION

Guest agrees to indemnify, defend, and hold harmless James River Hideout, LLC, Horsecreek Ranch & Retreat, LLC, Float the James, LLC, 3 Creeks Land and Cattle, LLC, and their respective owners, employees, and agents from any claims, liabilities, damages, losses, costs, or attorney fees arising out of:

• Guest's occupancy of the property

• Actions of Guest's family members, invitees, or visitors

• Damage to property

• Injury to persons

• Violations of this Agreement

• Conduct of any approved pet

DAMAGE AUTHORIZATION

Guest understands that no security deposit is collected; however, Guest remains financially responsible for all damages caused by themselves, members of their party, visitors, children, or approved pets. Guest authorizes James River Hideout, LLC to charge the credit card on file for:

• Excessive cleaning beyond normal turnover cleaning

• Missing or stolen items

• Damage to the cabin, furnishings, appliances, fixtures, linens, or equipment

• Pet-related damages

• Smoking or vaping remediation

• Septic system damage resulting from prohibited use

• Costs associated with violations of this Agreement

Management may document damages through photographs, video, contractor estimates, invoices, repair records, or other reasonable means. Charges will be limited to the actual cost of repair, replacement, remediation, or cleaning required as a result of Guest's actions.

CHARGEBACKS AND PAYMENT DISPUTES

By making a reservation, Guest acknowledges acceptance of this Agreement, the cancellation policy, and all fees disclosed during the booking process. Guest agrees to contact management directly regarding any billing concern prior to initiating a credit card dispute or chargeback. Documentation including reservation records, correspondence, signed agreements, photographs, and payment records may be used to contest any chargeback related to charges authorized under this Agreement.

PHOTOGRAPHY RELEASE

Guest grants James River Hideout, LLC and its affiliated entities permission to use photographs, video, and visual recordings taken in public areas of the property for promotional, advertising, and marketing purposes without compensation. Guest may opt-out or revoke use of their likeness in writing at anytime.

FIREARMS POLICY

Guest agrees, and shall cause all members of their party to obey all federal, state, and local laws regarding the ownership and possession of firearms. Firearms are not permitted inside common buildings or shared facilities. Firearms lawfully possessed may remain secured within a private vehicle where permitted by law. The discharge of firearms, BB guns, pellet guns, air rifles, or similar devices is strictly prohibited.

ANIMAL WAIVER

Guests bringing approved pets onto the property acknowledge and agree that they assume all responsibility for risks, injuries, damages, or other harm caused by or related to their animal. Guest releases and discharges James River Hideout, LLC, Horsecreek Ranch & Retreat, LLC, Float the James, LLC, 3 Creeks Land and Cattle, LLC, and their owners, employees, agents, and affiliates from any claims, damages, liabilities, injuries, demands, or causes of action arising from the presence of the animal on the property. Guest agrees to indemnify and hold harmless the foregoing parties from any claims, damages, liabilities, costs, or attorney's fees arising from or related to the animal's presence or actions.

ASSIGNMENT & SUBLETTING

Reservations are non-transferable without prior written approval. Guests may not sublet, advertise, rent, assign, or otherwise transfer their reservation through Airbnb, VRBO, Facebook Marketplace, or any other platform.

MISSOURI LAW NOTICE

UNDER MISSOURI LAW, A PRIVATE CAMPGROUND OWNER OR AN EMPLOYEE OR OFFICER OF A PRIVATE CAMPGROUND OWNER IS NOT LIABLE FOR AN INJURY TO OR THE DEATH OF A PERSON OR ANY PROPERTY DAMAGE RESULTING FROM THE INHERENT RISKS OF CAMPING UNDER THE REVISED STATUTES OF MISSOURI.

GOVERNING LAW

This Agreement shall be governed by and construed under the laws of the State of Missouri. Any dispute arising from this Agreement shall be brought exclusively in the courts of Stone County, Missouri, unless otherwise required by law.

ACKNOWLEDGMENT

By signing below, making payment, completing an online reservation, or taking occupancy of the cabin, Guest acknowledges that they have read, understand, and voluntarily agree to all terms contained in this Agreement, including the Assumption of Risk, Release of Liability, Animal Waiver, and Indemnification provisions.

Guest further acknowledges that they are responsible for ensuring that all members of their party comply with these Terms and Conditions.
